When should foreigners working in Thailand renew their work permits?

       Renewal of work permits for foreign workers in Thailand is governed by three regulations: the Working of Foreign Workers Act B.E. 2551;  the Ministerial Regulation on permission for the business of bringing foreigners to work with employers in the country;  and guarantees for bringing foreigners to work with employers in the country B.E. 2564. 

       It is stipulated that a licensee wishing to apply for a renewal of a license must submit an application for renewal of a permit to the Director-General of the Department of Employment at least 30 days before the work permit expires, together with the documents or evidence specified in the permit renewal application form. The supporting documents include application form TT 5, a work permit with a copy, a letter of employment certification, a passport that has been renewed with a new visa, a medical certificate showing that the person does not have any prohibited characteristics or diseases, documents according to the conditions specified in the work permit, Power of Attorney from a foreigner affixed with a 10 baht duty stamp, and the recipient's ID card.

       In this regard, the Director-General of the Department of Employment must complete the consideration within 15 days from the date of receiving the request for renewal of the permit. While waiting for the result, the foreign worker can continue to work until the registrar notifies them of the result of the consideration.  The renewal of the permit will be considered for a period of not more than two years at a time.

       However, if a foreign worker works after the permit has expired without submitting an application for renewal of the permit before the permit expires, or if they have submitted the application but the registrar has ordered that the permit not be renewed and the applicant has not appealed (or has already appealed, but the Minister of Labor has decided not to grant permission), they will be liable to imprisonment for not more than three months or a fine of not more than 5,000 baht, or both.

       In cases when the work permit is about to expire and the foreign worker is not in Thailand, the work permit can be renewed.  In this regard, the foreign worker must authorize the submission of an application for a renewal of a work permit, in accordance with the TT.5 form.
