Foreign Nationals Giving Birth in Thailand Have the Right to Apply for Nationality

Acquiring Thai nationality according to the Nationality Act B.E. 2508 (1965) and its amendments, Section 23, allows for Thai nationality by birth.

Criteria for Applying for Thai Nationality :

1. Types of eligible persons:

  • Persons born in Thailand before December 14, 1972, whose parents are foreigners temporarily residing in Thailand, have been granted special permission to stay, or are residing in Thailand unlawfully. These are persons who previously held Thai nationality by birth under the principle of jus soli but were stripped of their Thai nationality or are considered non-nationals under the Executive Order 337.
  • Persons born in Thailand between December 14, 1972, and February 25, 1992, whose parents are foreigners temporarily residing in Thailand, have been granted special permission to stay, or are residing in Thailand unlawfully.
  • Children of individuals under categories 1 or 2, born in Thailand before February 28, 2008.

2. Born in Thailand with proof of birth and registered in the civil registry.

3. Have good behavior or have contributed benefits to society or Thailand.


Required Documents for Application :

  1. Birth certificate or a certificate of birth (Tor.Ror. 20/1) or a certificate confirming the birthplace of the applicant for Thai nationality.
  2. House registration, personal history record, or additional documents as required by the civil registry.
  3. Evidence proving that the father or mother was born in Thailand.
  4. One 2-inch photograph.
  5. Identification card for stateless persons (if available).
  6. Alien certificate of residence (if available).
  7. Documents from agencies or organizations certifying good behavior or contributions to society (if available).
  8. Evidence proving good behavior or contributions to society (if available).
  9. Credible witnesses who can provide certification and identity verification.

Applying for Thai nationality under Section 23 of the Nationality Act requires meeting the qualifications and providing the documents listed above. The application is subject to review by relevant authorities, who will meticulously verify the applicant's details and qualifications.
