Criteria for Obtaining a License to Provide Employment for Workers Abroad - Application Submission at the Provincial Employment Office Where the Applicant has Set up Office (Foreign Employment License)

     Any private entity wishing to engage in the business of job placement for job seekers to work abroad must apply for a foreign employment license from the Central Employment Registrar. If the office is located in Bangkok, the application must be submitted to the Central Job Placement and Labor Protection Registration Division, Department of Employment. If the office is located in other provinces, the application must be submitted at the Provincial Employment Office where the applicant has established its office.

The qualifications of the applicant for a license to provide employment for workers abroad are as follows:

  1. The applicant must be a limited company or a public company that has fully paid-up registered capital of not less than 1 million baht.
  2. The proportion of shares held by Thai nationals must be no less than three-fourths of the total capital, including all shareholders.
  3. The manager must possess the qualifications and not have the prohibited characteristics under Section 9 as follows:                 
    1. Must be a Thai national.
    2. Must be at least 20 years of age.
    3. Must not be a licensee of any other job placement business.
    4. Must not be a person who is under suspension of a job placement license.
    5. Must not have ever had a job placement license revoked.
    6. Must not be a person incapable or quasi-incapable.
    7. Must not be a person who is or has been of bad behavior or deficient in good moral conduct.
    8. Must not be a director, partner, or manager of another job placement licensee.
    9. Must not be a director, partner, or manager of a legal entity whose job placement license has been revoked, or who is in the process of exercising the right to appeal against the revocation order.
    10. Must never have been sentenced to imprisonment by a final judgment or a lawful order to imprison for offenses that the law stipulates are offenses involving dishonest acts or offenses under this Act.
  4. Must deposit a guarantee of 5 million baht with the Central Employment Registrar.

     The workflow will start from when the official checks that all documents are complete as specified in the public service manual. If the application or supporting documents are incomplete or defective and cannot be considered, the official will prepare a record of document deficiencies or required additional documents. The applicant must rectify the deficiencies and/or submit additional documents within the time specified in the record, otherwise, it will be considered that the applicant has abandoned the application. The record shall be signed by the official and the applicant or the authorized person and a copy of the record of deficiencies shall be given to the applicant or the authorized person as evidence. The result of the consideration will be notified to the applicant within 7 days from the date of completion of the consideration.
