The Notification of the Ministry of Transport Re: Criteria for Considering Permission for Marine Transport Operators to Charter and Use Non-Thai Vessels for Marine Transport with the Same Rights and Benefits as Thai Vessels (No. 2), dated 15 October 2004, requires marine transport operators who hold ownership of Thai vessels to apply for permission for charter and use of non-Thai vessels to supplement the number of vessels on the routes of their transport business, so that they may receive the same rights and benefits as Thai vessels during the entire period of renting. Those who wish to apply for permission must prepare the following documents:

1. Form Phor Wor-Khor 3;
2. The certified copy of the lease or charter agreement which contains the vessel’s name, owner’s name, nationality, freight, vessel age, charter duration, and type of charter, or other contracts. In case there is no charter agreement, other evidence containing the vessel’s information as in a charter agreement must be presented;
3. A copy of the registration certificate of marine transport operator under the Merchant Maritime Promotion Act, B.E. 2521 (1978);
4. The copy of the ship registry certified by the Marine Department not exceeding 30 days from the date submitting the application;
5. In the case of an ad hoc rent, evidence showing that other Thai vessels are unable to provide transport service must be presented;
6. The copy of sailing schedule of the Thai vessels operating on the route to obtain permission;
7. The copy of bill of lading of Thai vessels operating on the route to obtain permission;
8. Identification card or passport;
9. Company affidavit or power of attorney.
