Criteria for Applying for a License to Establish an Onshore Warehouse for Storing Liquefied Petroleum Gas

     For those wishing to apply for a license to establish an onshore warehouse for storing liquefied petroleum gas, an application must be submitted to the Director-General of the Customs Department as prescribed by the Director-General, accompanied by documents and evidence. The essential criteria for obtaining a permit are being a state enterprise, a government agency, or a company or partnership with registered capital and stable financial status, with the financial statements reflecting no accumulated losses. The qualifications are as follows:

  • Registered capital of the applicant
    • If the proposed onshore warehouse location is within the area of Bangkok, Nonthaburi, Pathum Thani, Nakhon Pathom, Samut Prakan, Samut Sakhon, or Chachoengsao, the paid-up registered capital must not be less than twenty million Baht or have a paid-up registered capital in an amount deemed appropriate by the Director-General for the type of business.
    • If the proposed onshore warehouse location is within other areas outside those mentioned in (1.1), the paid-up registered capital must not be less than ten million Baht or have a paid-up registered capital in an amount deemed appropriate by the Director-General for the type of business.
  • The applicant must not have a severe criminal record under customs law and other laws relating to customs in the past three years from the date of application. A severe violation of the law refers to any violation that the law stipulates as punishable with imprisonment. 
  • The applicant must hold the property rights, ownership rights, or rights to use the area where the warehouse is to be established legally. If the land for the warehouse has a mortgage registration, the mortgagee must provide a written consent to establish the warehouse.
  • The applicant must not be in the process of having a similar type of license suspended.
  • The applicant must not have had a similar type of license revoked unless the license was revoked more than three years before the date of application. If the applicant is a legal entity, the executives of the entity should not be under the aforementioned prohibitions.
