What kind of penalties may be imposed when foreigners violate laws on the operation of prohibited businesses?

       A foreigner who has been granted a license to operate a business under the Foreign Business Act B.E. 2542 (1999) may not take part in a business owned by other foreigners who are not permitted to operate their business under this Act. Moreover, the foreigner may not operate an unauthorized business owned by such other foreigners, under the pretense that he/she is the sole owner of the business, in order to prevent such other foreigners being caught violating the provisions of this Act. A foreigner committing the above acts is subject to imprisonment for not more than 3 years or a fine from 100,000 baht to 1,000,000 baht or both, and the Court shall order the dissolution of such joint business or business operation. Violators of the Court’s order shall be subject to a fine of 10,000 baht to 50,000 baht per day throughout the period of violation.
