Establishment of location, safety and service standards for health establishments of spa and massage business for health or beauty purposes.

Guidelines for the operation of health establishments.

               For the guidelines for the operation of health establishments, the relevant law is, the Ministerial Regulation on Establishment of Location, Safety, and Service Standards for Health Establishments of Spa and Massage Business for Health or Beauty Purposes B.E. 2561 (2018). The subject matters of this ministerial regulation are as follows.

               1. In the event that the health establishment is in the same building as other businesses, the service area must be clearly divided and allocated. Such other businesses must not be bathing, massage or steaming establishments that provide services to customers according to the law on entertainment places, and must not interfere with the provision of services in such health establishment.

               2. The area within a health establishment must not have access for service providers or the customers to enter the entertainment place according to the law on entertainment places.

               3. In the event that a health establishment provides several types of services in the same building or location, there must be a clear division of services. The area and characteristics of each section must meet the standards of each service. For example, the surface of the areas where water is used must be made of non-slip material, the place is appropriately decorated and does not have any characteristics that are degrading or contrary to good culture and traditions, and personalized service area must not be too private or out of sight.

In addition, health establishments such as spa businesses must provide hygienic, safe and adequate shower rooms, toilets, sinks, changing rooms, and closets separated for men and women. A health establishment of massage business for health or for beauty purposes may also provide shower rooms.

The safety standard requires basic first aid equipment, signs or messages warning the customers to be aware of danger in risky areas, all equipment and tools must be hygienically cleaned after use or service, a mask must be worn at all times to prevent the transmission of respiratory pathogens from the customers. In addition, the establishment must have an appropriate waste collection system preventing infection from waste and a fire alarm system.

For a health establishment that provides steaming, sauna or whirlpool baths, hot or cold-water baths, it is required that the establishment must have service providers or employees who are knowledgeable and skilled in the use of equipment. The clock abd thermometer must be easily visible and readable. In addition, an emergency system that can automatically stop the operation of various equipment is required if there is a situation that may be dangerous to the customers. 

The health establishments of spa business must have a screening system for customers and must not provide services to pregnant women and users of certain drugs who may experience problems or be harmed when using certain equipment. 

Health establishments of massage business for health or beauty purposes must be careful not to allow customers who are at risk due to their age or congenital disease to use the service which may be harmful to their health. 

For service standards, the Practice of the Art of Healing Act, law on the practice of medicine and public health, Entertaining Place Act or Medical Facilities Act must not be violated. In addition, the list of services and service rates must be displayed in a conspicuous and visible place or can be reviewed at the health establishment. The uniforms of service providers must be neat, clean and convenient for work and has a name tag on the chest area. The business hours of a health establishment must be clearly and definitely defined, which can be from 6:00 AM to 12:00 PM. A health establishment of spa business must have the customer account records as evidence as prescribed by the Director-General.
