For those who wish to apply for permission to operate a health business establishment in Thailand, you shall apply for a license under Section 22 of the Health Business Establishment Act B.E. 2559 (2016) stating that any person who wishes to perform duties as a service provider in a health business establishment shall submit an application for registration as a service provider to the Grantor. An applicant for registration as a service provider must have following qualifications.
- At least 18 years of age;
- Having obtained a diploma or a certificate in health service which is accredited by the Department of Health Service Support;
- Not being a person of unsound mind, an incompetent person or a quasi-incompetent person;
- Not being a person who had been convicted by a final judgment for a sexual offence under the Criminal Code, an offence under the law on narcotics, an offence under the law on prevention and suppression of prostitution, unless the person has been released for not less than one year prior to the date of submission of the registration application;
- Not being a person who suffers from a communicable disease regarded as abhorrent to the society, alcoholism, or narcotics addiction;
According to the Regulations of Ministry of Public Health on the registration as a service provider in a health establishment, B.E. 2560 (2017), those who wish to submit for registration application in Bangkok area shall submit documents at the one-stop service center, 1st floor, Department of Health Service Support, Ministry of Public Health during office hours and if you are in a provincial area, you can contact the Provincial Public Health Office or submit for registration application through the system on website www.spa.hass.moph.go.th.
Evidence supporting the request for permission is as follows.
For general person, supporting evidence consists of a copy of an identification card, a copy of house registration, and a medical certificate (certifying that the person is free from 5 prohibited diseases and no later than 30 days from the date of issuance of the medical certificate).
For a juristic person, the supporting evidence consists of the certificate of juristic person registration (specifying the objectives of the health business operation such as spa business, health massage business, beauty massage business), a copy of the authorized signatory’s identification card, a copy of the authorized signatory’s house registration, the authorized signatory’s medical certificate (certifying that the person is free from 5 prohibited diseases and no later than 30 days from the date of issuance of the medical certificate).
In the event that the applicant submits the application and the officer accepts such application, a certificate of application shall be issued as evidence within 15 days from the date of submission of the application form. If the officer finds that the documents or evidence are inaccurate or incomplete, he/she shall make a written notice to the applicant to make corrections within 30 days from the date of receipt of the letter. However, the officer shall notify the result of the consideration to the applicant within 60 days from the date of receipt of complete documents and evidence.
