Warning to entrepreneurs that using carbon reduction labels without permission risks prison and hundreds of thousands in fines

      People around the world, including in Thailand, are aware of the severity of natural disasters, which are partly due to greenhouse gas emissions from activities from the industrial sector, the agricultural sector, and people’s daily life. Because of this situation, manufacturers and service providers, including the public as consumers, are coming together to produce and use more environmentally friendly products to help resolve and reduce such problems.

      One of these is carbon reduction labeling, which manufacturers use to show consumers how much GHG emissions are emitted by each production process. In Thailand, to use carbon reduction labels, the business must register it as a service mark from the Thailand Environment Institute.

      Any person who uses the carbon reduction label without permission will be punished under the Trademark Act B.E. 2534, as follows:

       - Section 108: Any person who counterfeits trademarks, service marks, certification marks, or co-marks with other registered persons shall be liable to imprisonment for a term not exceeding 4 years, a fine not exceeding 400,000 baht, or both;

       - Section 109: Any person who imitates trademarks, service marks, certification marks, or co-marks with other registered persons in order to mislead the public, shall be liable to imprisonment for a term not exceeding 2 years, a fine not exceeding 200,000 baht, or both.
