Criteria for considering petty patent registration

     Invention means creative ideas related to a product's structure, components, or mechanism, including methods of production, storage, or improvement of product quality or the creation of new products that are different from the original.

     The purpose of petty patent registration is to provide legal protection for used or useful inventions and prevent others from using the invention for their own benefit without permission. An invention that applies for petty patent registration must include the following characteristics:

  1. The invention is a new creation;
  2. The invention is applicable in an industrial field; 
  3. The following inventions shall not be protected by the Patent Act:
    • Microorganisms and any components of the microorganisms naturally existing in animals, plants, or extracts from animals or plants;
    • Scientific or mathematical principles and theories;
    • Data system for the operation of a computer;
    • Method of diagnosis, treatment, or cure of human diseases or animal diseases; 
    • Inventions contrary to public order, morality, health, or welfare.
