Application for extension of stay for foreigners who are family members of a foreigner permitted to temporarily stay in Thailand to study in an educational institution

         Permission for extension of stay in Thailand for foreigners who are family members of a foreigner allowed to stay temporarily to study in an educational institution is granted only for a father, mother, spouse, child, adopted child, or spouse's child. The requirements are as follows:

1. Foreigners must hold a Non-Immigrant Visa; 

2. Proof of relationship;

3. In case of spouse, evidence of a legal and de facto relationship is required;

4. In the case of a child, adopted child, or spouse's child applying to be in patronage, the child, adopted child, or spouse's child must not be married, must live as part of that household, and must not be over 20 years of age;

5. In the case of the father or mother, he or she must have a deposit in a bank in Thailand in the name of the father or mother's account balance of not less than 500,000 baht for the past 3 months. Only in the first year, a deposit account with that amount of money must be in the account for not less than 30 days before the date of application for extension.

Required documents

1. TM.7 form;

2. Copy of the applicant's passport;

3. Copy of the passport of the foreigner who is permitted to stay for study;

4. Copy of relationship documents, such as proof of marriage, copy of birth certificate, proof of birth registration, copy of house registration, proof of registration of adoption, or other documents from public agencies or relevant agencies.

        When the foreigner is granted permission to stay in Thailand, the competent official will stamp the permission stamp in the passport specifying the date until the visa is valid on the stamp, together with the signature and date stamped.

        If the foreigner travels out of the Kingdom, the residence permit will be terminated in accordance with Section 39 of the Immigration Act 1979, unless the person notifies the competent official that he or she wishes to apply for a Re-entry Permit to reserve the right for re-entry. The competent officer will stamp a Re-entry Permit in the passport and the foreigner will be allowed to re-enter and stay in the Kingdom for as long as the remaining period of such permission is granted.
