Guidelines and Accompanying Documents for Hazardous Substance Registration

     According to the 1992 Hazardous Substances Act, hazardous substances are classified into four types according to the level of danger, risk, and the need for control. Those who wish to manufacture or import hazardous substances, that have high danger or risk, must first obtain a certificate of registration before they can proceed with manufacturing or importing hazardous substances. Or they can get permission to manufacture or import hazardous substances in cases of hazardous substances such as household or public health pest control products containing benzyl benzoate or pyrethroids group substances as key ingredients, as well as cleaning / disinfectant products containing acids, alkalis, or aldehydes group substances as key ingredients.

     The criteria and procedures are as follows:

  1. Applying for permission to manufacture or import samples of hazardous substances must comply with the following notifications:
    • The Ministry of Agriculture and Cooperatives’ 2008 Announcement regarding the registration, issuance of certificates, and renewal of certificates for hazardous substances under the responsibility of the Department of Agriculture
    • The Department of Agriculture’s 2009 Announcement regarding the criteria, procedures for registration, issuance of certificates, and renewal of certificates for hazardous substances under the responsibility of the Department of Agriculture. 
    • The Department of Agriculture’s 2011 Announcement regarding the concentration rate in each formula of registered hazardous substances.
    • The Department of Agriculture’s 2013 Announcement regarding the concentration rate in each formula of registered hazardous substances (2nd version).
    • The Department of Agriculture 2013 Announcement regarding the concentration rate in each formula of registered hazardous substances (3rd version).
    • The Department of Agriculture’s 2014 Announcement regarding the concentration rate in each formula of registered hazardous substances (4th version).
    • The Department of Agriculture’s 2014 Announcement regarding the concentration rate in each formula of registered hazardous substances (5th version).
  2. In case officers have doubts about the evidence submitted, they can request the applicant to provide additional explanation.
  3. The operational steps according to the manual will start counting from the time the documents are verified as complete and correct as stated in the public manual.

     Documents and Evidence Required for Hazardous Substances Registration:

  1. Request for hazardous substance registration form (Form Wor Oor/Kor Sor/Kor Wor Kor 1) (1 original copy)
  2. Request for permission to manufacture or import hazardous substance samples form (Form Wor Oor/Kor Sor/Kor Wor Kor 12) (1 original copy)
  3. Toxicology data phase 1 (tox phase1) (6 copies)
  4. Efficacy/Residue testing plan (6 original copies)
  5. Registration/production license in the country of origin (2 copies)
  6. Letter of Authorization to use toxicological data (LOA) (1 original copy)
  7. Power of attorney letter (1 original copy)

     Document details: The letter must be affixed with a 10 baht stamp duty (per use) or 30 baht for 1 year, all copies must be certified, copy of the ID card of the authorizer.

     There is a fee of 300 baht for a license to manufacture or import samples. The entire process takes 14 days in total, including 1 day for document verification, 12 days for consideration, and 1 day for signing.
