Support documents for petty patent registration

     The “petty patent” is an important document issued by the state to protect inventions that are similar to the invention but are not highly developed in terms of technological advancement or are minor inventions that are more useful; it includes methods of production, preservation, or improvement of the product quality, or the creation of new products that differ from existing ones. Examples include the mechanism of a machine, medicines, methods for preserving vegetables and fruits to prevent them from spoiling too quickly, etc.

Petty patent registration requires the following documents:

  1. Petty patent application form (Form Sor Por/ Sor Phor/ Or Sor Por/ 001-Kor);
  2. Transfer agreement specifying the details of the invention being transferred, signed by the transferor, transferee, and two witnesses;
  3. National ID card;
  4. Document details: national ID card of petty patent attorney (if any);
  5. Document details: invention assignee (if any);
  6. Certificate of juristic person if the 13-digit business registration number is not specified in the application form, and a copy of the certificate issued not more than 6 months from the date of issuance of the certificate. If the juristic person number is specified in the application form, no document copy is needed as the officer can retrieve information from the Department of Business Development;
  7. Power of attorney;
  8. Statement of applicant’s right to apply for a petty patent (Form Sor Por/ Sor Phor/ Or Sor Por/ 001-Kor(Por)).

     The registration of a petty patent application will take approximately 8 months and 21 days to process, depending on several factors, such as the completeness and accuracy of the documentation, the examination by the examiner, the time taken by the applicant to respond to requests for amendments or clarifications, and the internal procedures of the Department of Intellectual Property.
