Documentation for registering a patent for an invention

     A patent is a privilege granted by law to the patent owner to protect inventions or product designs from being used by others for profit, such as manufacturing, using, selling, or importing without permission. Patents can be divided into two categories: invention patents and product design patents.

     “Invention patent” means the protection of inventions relating to the product's composition, structure, and mechanism, including processes for production, storage, or quality improvement of products. Those who wish to patent their invention must prepare the following documents:

  1. National ID card;
  2. Patent registration form (Form Sor Por/ Sor Phor/ Or Sor Por/ 001-Kor);
  3. Deed of assignment contract indicating the transferred invention detail with signature of the assignor (inventor), assignee, and 2 witnesses (if any);
  4. Other relevant documents as stipulated in item 14 (Form Sor Por/ Sor Phor/ Or Sor Por/ 001-Kor);
  5. National ID card of the patent agents or patent attorney (if any);
  6. National ID card of the invention assignee (if any);
  7. Certificate of juristic person if the 13-digit business registration number is not specified in the application form, and a copy of the certificate issued no more than 6 months from the date of issuance of the certificate. If the juristic person number is specified in the application form, no document copy is needed, as the officer can retrieve information from the Department of Business Development;
  8. Power of attorney;
  9. Statement of applicant’s right to apply for a patent (Form Sor Por/ Por/ Or Sor Por/ 001-Kor (Por)).

     In this regard, the process of applying for a patent typically takes around 50 months and 111 days, or 4-5 years, depending on several factors, such as the completeness and accuracy of the documentation, the details and content of the invention, the examination by the examiner, the time taken by the applicant to respond to requests for amendments or clarifications, the document management system, and the internal procedures of the Department of Intellectual Property.
