Conditions and procedures for registering a patent for a product design

     When registering a patent for a product design, the designer or patent applicant must study the registration process details from the Department of Intellectual Property. 

The applicant must submit the following supporting documents:

1. In case the designer is the applicant:

    • Certification of rights, form Sor Por/ Sor Por/ Or Sor Por/ 001-Kor (Por).

2. In case the designer transfers the right to someone else to apply for a patent (individual):

    • A transfer rights agreement.

3. In case the right is transferred to a legal entity:

    • A transfer rights agreement.

4. If the patent applicant wants to appoint an agent, the power of attorney can be granted to a registered IP agent with the Department of Intellectual Property. Documents required for this include:

    • Power of attorney, attached with duty stamp of 30 baht;
    • Copies of the ID card of both the person granting the power and the agent.

Conditions for registering a patent for product design

  1. It must not already exist or be widely used in the Kingdom before the date of granting the patent;
  2. It must not disclose pictures, essences, or details in the documents, or publications that have already been published, whether in or outside the Kingdom, before the date of applying for a patent;
  3. It must not have been advertised under the provisions of sections 28 and 65 of the patent acts before the application date.

Steps for registering for a patent for product design

  1. Prepare and apply;
  2. Conduct a preliminary examination and make corrections within 90 days if there are any errors, and pay the advertising fee;
  3. Advertise the application, and third parties may file an opposition within 90 days;
  4. Check the product’s originality and novelty;
  5. Pay the registration fee;
  6. Registration.

Preparation of application

  1. Prepare the registration patent application form (form Sor Por/ Sor Por/ Or Sor Por 001-Kor);
  2. Specification of rights (specify the number of pages);
  3. Product design drawings (paintings or photographs must be displayed in a way that does not obscure the shape or product details, etc.);
  4. Product description (if any).
