Documentation for Application for Overseas Job Placement License - Case of Application at the Provincial Employment Office where the Applicant has Established Office

As stipulated in the 1985 Occupational Job Placement and Labor Protection Act, Article 30 prohibits anyone from providing job placement services for individuals seeking employment abroad unless permission has been granted by the Central Employment Registrar. Moreover, Article 50 prohibits foreign employers or their representatives from directly recruiting employees in Thailand to work overseas. They must coordinate with the Employment Office or the Department of Employment to make arrangements. Therefore, to provide job placement services for individuals seeking employment abroad, one must properly apply for a permit. For example, to apply for a license to offer job placement services for individuals seeking to work abroad at the provincial employment office where the applicant has established an office (Overseas Occupational Placement License), the following documents must be prepared for review:

  1. Application for Overseas Job Placement License (Chor Ngor 5) (Original copy)
  2. Report of Background Check and Fingerprint (Original copy), must not be older than 30 days
  3. Certificate of Business Registration (1 copy), must not be older than 6 months, showing a registered capital and paid-up capital of not less than one million baht, including the purpose of the business and the authorized signatory on behalf of the applicant entity. It should also show that the number of shareholders and capital belonging to shareholders of Thai nationality is not less than 3/4 of the total number of shareholders and capital.
  4. Power of Attorney letter (1 copy) with 30 baht stamp duty
  5. Identity Card and House Registration of the authorized person on behalf of the legal entity (1 copy)
  6. House Registration, Identity Card, or first page of Passport (if foreigner) of all partners (1 copy)
  7. Medical Certificate attesting that the authorized person on behalf of the applicant entity is not a person incapacitated or quasi-incapacitated (not older than 1 month)
  8. Half-body, front-facing photograph without hat or glasses (3 original copies) size 4x6 cm of the authorized person on behalf of the applicant entity (taken not more than 6 months ago)
  9. Documents showing ownership or occupancy rights of the office location (1 copy)
  10. Map and photographs of the place of business (1 original copy) including interior and exterior office pictures
  11. Job Placement Guarantee (1 original copy) amounting to 5 million baht (cash, or Thai government bonds, or bank guarantee). In the case of bank guarantees, they must be written as stipulated in the Chor Ngor 2 form
  12. Power of Attorney (1 original copy) with 10 baht stamp duty, along with a copy of the authorizer’s ID card and the original ID of the person being authorized.
