Foreign ownership of land in Thailand: Fees and taxes

      Besides preparing the necessary documents and taking the steps to acquire the land, foreigners who want to purchase land must also prepare to pay the costs for acquiring land rights in Thailand. There are several types, described below.

Fees 

  1. For application for foreign land acquisition, the fee is 500 baht per person. 
  2. Permission fee: The collection rate is 100 baht per rai. 
  3. Registration fee for the administrator of the estate: The collection rate is 50 baht per plot. 
  4. Inheritance transfer fee: The collection rate is 2% of the property's appraised value (except for the transfer of inheritance between parents and descendants, or between spouses, in which case the collection rate is 0.5% of the appraised value).  
  5. Transfer fee for buying land or condominium: The charge rate is 2% of the property's appraised value.  
  6. Transfer fee to the condominium: The charge rate is 0.5% in the case of giving the unit without compensation between parents and descendants or between spouses.

Withholding tax 

  1. In the case of inheritance under Section 93, there is no need to pay. 
  2. In other cases, such as purchase, acceptance, the collection rate is divided as follows: juristic persons must pay 1% of the appraised value; ordinary individuals are subject to a progressive rate calculated from the appraised value, according to the method prescribed in the Revenue Code.

Specific business tax 

  1. In the case of inheritance under Section 93, there is no need to pay.
  2. In other cases, such as purchase or acceptance, the collection rate is 3.3%, including local tax on the appraisal value or higher cost.

Stamp duty 

  1. In the case of inheritance under Section 93, there is no need to pay.  
  2. In other cases, such as purchase, or acceptance, the collection rate is 0.5%, including local tax on the appraisal value or higher cost.
