Application to stay in Thailand for business

Foreigners wishing to apply for a residence permit in Thailand in case of business, such as working in a company or partnership, must hold a Non-immigrant visa, have income, and conduct a business with a paid-up capital of at least 2 million baht, and the business must submit financial statements for the past two fiscal years, which have been audited by a certified public accountant or a tax auditor, as the case may be, to show that the business is stable, reliable, and legitimate. Approval will be based on the legitimation and continuity of the business attached to this document (Appendix B), and whether the business needs foreigners to work there. It must have a ratio of 1 foreign employee / 4 permanent Thai employees. The following types of businesses – including international trade business (representative office)/regional office/multinational company (branch offices) –  are exempt from items (3), (4), and (5) and are given a waiver in the ratio of Thai nationals in under item (6) requiring 1 foreign employee/ 1 Thai employee.

Supporting Documents:

  1.  TM.7 form, one photo size 4×6 cm, and 1,900 baht fee (foreigners must submit the application in person);
  2.  Copy of the applicant's passport (pages with photo, visa, latest entry stamp, departure card (TM.6), Re-Entry Permit, latest extension permit, and the foreigner’s signature on every sheet);
  3.  Certificate of employment for foreigners according to the form of the Immigration Office (STM.1);
  4. Copy of the work permit (pages with information displayed and the foreigner’s signature on every sheet);
  5. Copy of the organization's proof of incorporation, such as a certificate of company registration or partnership registration certified by the registrar within the last 6 months;
  6. Copy of the list of all shareholders certified by the registrar within the last 6 months;
  7. Copy of the latest year's balance sheet and income statement with corporate income tax return form (PND.50) and receipt and copy of Sor.Bor.Chor.3 (certified by the Revenue Department or the Ministry of Commerce or from the auditor or original documents only);
  8. Copy of the withholding income tax return (Por.Ngor.Dor1) with the name of the Thai employee and the name of the foreigner applying, within the last 3 months, with the receipt (in case of no name of the foreign, a letter of clarification is required and the foreigner must not be listed in P.N.D.1 before obtaining a work permit);
  9. Copy of the personal income tax return form (PND.91) of the latest applicant with receipt (if any);
  10. Copy of Social Security Fund Contributions Payment form (Sor.Por.Sor. 1-10) of the last 3 months with receipt;
  11. Copy of VAT return form (Por.Por.30 or Por.Por.36) of the last 3 months of the latest financial year with receipt;
  12. Documents or proof showing that the business requires foreign employees; for example, the company recruits Thai employees but there are no Thai applicants;
  13. Map showing the applicant's workplace (company seal and authorized signatories); 
  14. Other documents or proof; 
  15.  Photos of the establishment (company seal and authorized signatories on every sheet):
    • Outside: photos of the building, location number, and establishment nameplate;
    • Inside: photos of Thai and foreign employees while working.

    16. Original documents according to items 5, 6, 7, 8, 9, and 10;

    17. In the case of a family accompanying, family proof is required, such as a marriage certificate, or birth certificate. If issued by the government in a foreign country, it must be certified by the embassy of that country.

          The documents specified in items 8-11 must be verified by the relevant public agency.
