Applying for or requesting to change the type of visa of a foreigner to perform duties or missions in the family of an alien who performs duties in a company or partnership company (Code O) can be granted for no more than 90 days, and the current visa must have a remaining period of more than 15 days. Applicants who are overstaying may not file a claim.  

Supporting documents:

1. TM.86, only for foreigners who have Tourist Visa or Transit Visa, to change the type of visa, or TM.87 form, only for foreigners who do not have a visa but are allowed to stay in the Kingdom, and P.30, PP.30 and PP.90 to apply for a visa;     

2. Copy of passport (such as personal information page, entry stamp, residence permit stamp (if any)), and departure card (TM.6);     

3. 1 4X6 cm or 2-inch photo;     

4. Fee of 2,000 baht;

5. A copy of the passport and a copy of the work permit of the person performing duties or missions in the Kingdom;

6. Certificate of registration of juristic person where the alien performs their duties, with objectives (certified by the registrar for not more than 6 months);

7. Value Added Tax Registration Certificate (Phor.Por.20);

8. List of shareholders (BOJ.5) (certified by the registrar within the past 6 months);

9. Copy of proof of parentage, child, marriage certificate or birth certificate or certificate from government agency, embassy or consulate showing that is part of the household, certificate from the Department of Diplomatic Protocol, Ministry of Foreign Affairs (must be translated into English and certified by the embassy of the foreigner in Thailand or abroad and by the Legal Affairs Division, Department of Consular Affairs, Ministry of Foreign Affairs in Thailand);

10. Copy of the withholding tax list of Thai employees (Por.Ngor.Dor.1) (for the past 3 months, together with a list of Thai employees from the 1st to the last), must be certified by the Revenue Department together with the receipt)

11. A copy of the latest income tax withholding of foreigners (PND91) (if unable to present, please clarify the reason to Immigration Office Commander).

Things you should know: 

1. Both the applicant and the person to be followed must come to take action on both sides every time. 

2. The applicant who contacts must notify the residence according to section 38 with evidence of the residence notification.

3. The applicant must sign and certify every page of the document. 

4. The person to be followed l must be allowed to stay in the kingdom for 1 year.     

5. In the case that the applicant is a child, adopted child, or spouse's child applying to be in patronage, a child, adopted child, or spouse's child must not be married and reside as part of the household and must not be over 20 years of age     

6. In case the applicant is a father or mother, that father or mother must be at least 50 years of age.    

7. For documents of the company or partnership, the authorized directors according to the certificate of registration or the managing partner must sign and certify every page as well as stamp the company or partnership seal.

8 For convenience and speed in the process, please bring complete documents and submit all original documents to the competent officer.
