Criteria and Conditions for Issuing Process Statement Endorsement (Annex IV), Department of Fisheries

     Those who wish to apply for Processing Statement (Annex IV) under the supervision of the Department of Fisheries, Ministry of Agriculture and Cooperatives must meet several criteria, as follows:

  1. Those who wish to apply for Processing Statement (Annex IV) must comply with the Fisheries Decree, B.E. 2558 (2015), the Fisheries Decree (No. 2), B.E. 2560 (2017), and Regulations of the Department of Fisheries on the determination of form and method for submitting the application for catch certificate, or producing or processing certificate, B.E. 2562 (2019). 
  2. The applicants must submit the application through the Processing Statement Endorsement (PSE) on the website http://fsw.fisheries.go.th/, not less than 3 working days before export. In case of new business operators, the applicant must submit the application for registration in person and obtain a username and password to access the PSE system at the Fish Quarantine and Inspection Division, Department of Agriculture, Kaset Klang Subdistrict, Chatuchak District, Bangkok. It may also be done at the Fish Quarantine Inspection Regional Center 1 (Chiang Rai), Fish Quarantine Inspection Regional Center 2 (Bangkok), Fish Quarantine Inspection Regional Center 3 (Songkhla), the Don Mueang Airport Fish Inspection Office, and the Suvarnabhumi Airport Fish Inspection Office. The application may be submitted on the official date and time with additional documents and evidence specified for each type of registration application.
  3. If the operator is unable to submit an application through the electronic system of the Department of Fisheries, they must comply with the regulations on the determination of form and method for submitting the application for catch certificate, or producing or processing certificate B.E. 2562 (2019).
  4. The certification for operators importing aquatic products to be processed and exported to the European Union covers fishery products caught from the sea according to customs coordinates 03, 1604, 1605, except for certain produce items, e.g., products from aquaculture farms and bivalve shells. To import such aquatic products, the applicant must submit catch certificates issued by the owner of the foreign vessels, and the processing statement (Annex IV) to confirm that the imported aquatic products for processing are not from IUU fishing, and are not from countries that do not cooperate with the IUU, in order to promote the export of Thai aquatic products to meet international standards.

Conditions for issuing processing statement

  1. The factory must be on the list certified by the Department of Fisheries;
  2. The factory must be on the EU-certified factory list;
  3. The factory must not be suspended from the aquaculture hygiene certificate and/or the processing statement;
  4. In case of incomplete or incorrect application or supporting documents or the officer is in doubt, the officer must notify the applicant to complete or correct the application and documents within a reasonable period of time. If the applicant fails to take any corrective action within a specified period of time, it shall be assumed that the applicant no longer wishes to apply for the processing certificate (Annex IV);
  5. The applicant must track the status of the certificate through the PSE system after the application has been submitted in accordance with the prescribed procedure and duration. When the approval is granted, the applicant may request and receive a copy of the certificate with the agency that the applicant specified in the application process;
  6. The implementation procedure, according to the Public Handbook, starts from the date the officer accepts the complete and correct application and documents;
  7. The Public Handbook is for operators who wish to sign an electronic signature with the issuing authority only. Operators who do not possess an electronic signature must comply with the prescribed regulations.
