Criteria and Conditions for Applying for Permission to Use Foreign Vessels for Trading in Thai Waters

Those who wish to use foreign vessels for trading in Thai waters must apply for permission, in keeping with specified criteria and conditions, as follows: 

1. It is allowed to request permission to use foreign vessels of a person not qualified to hold ownership of a Thai vessel for trading in Thai waters only in the case that the number of Thai vessels operating is not enough for the demand of the country;

2. The applicant must be a juristic person established under Thai law and have an office located in Thailand;

3. The applicant must notify their intention according to Form Kor Tho 2 at the Ship Standard Registration Office or the Regional Port Office under the Port Authority, in order to acquire the Thai vessel for operating, with the specified information, as follows:  

1) Purpose of using the vessel;
2) Route or area of using the vessel;
3) Duration of using the vessel;
4) Number of the vessel;
5) The attributes of the desired vessel. 

     The notification shall be issued for not less than 15 days.

4. The applicant must submit the Form Kor Thor 2-1, together with supporting documents, within 30 days after the end of the vessel acquisition, and if there is no Thai vessel operator submitting an intention for the same type of trading;

5. The law specifies that foreign vessels may trade in Thai waters for a period of not more than one year or not exceeding the period under the contract of employment or not exceeding the period specified in the application for permission, whichever ends first;

6. The applicant must comply with the conditions specified in the permit, in Form Kor Thor 2-2;

7. In case of non-approval, the applicant has the right to proceed in accordance with the law on administrative practice and the law on the establishment of administrative courts and administrative court procedures.
