Notification When Ships Other Than Thai Ships Arrive at Destination Ports in Thailand

     According to the regulations of the Marine Department, which aim to promote maritime commerce, persons who order or import goods from abroad should have the goods assigned to be carried by Thai ships. Nonetheless, there are rules and procedures for granting permission to the persons ordering or importing goods from abroad and carrying those goods by ships other than Thai ships, B.E. 2564 (2021). In the case of notification when a ship other than a Thai ship arrives at the port of destination in Thailand, if the business requests permission to use a ship other than a Thai ship, there are methods and conditions for obtaining permission, as follows:

     The licensee must notify the Marine Department of the arrival of the goods permitted to be carried by other than Thai ships (Form ERC. 04) immediately upon receipt of the import permit with the excise tax return form and VAT from the Customs Department. After that, the officer will review the application for permission to report the use of other ships, to determine whether it is in accordance with the specified law on the use of Thai ships or not.

     However, in the case that the person ordering and importing goods specified to be carried by Thai ships is using ships other than Thai ships without permission, there will be a penalty under section 22 for the shipper to pay a special fee equal to 2 times the freight for the carriage of such goods in accordance with the specified rules.

Methods and Conditions for Submitting a Request and Considering Permission

     The ordering person and importer should submit an application form ERC. 01 or ERC. 04, depending on your case, and attach the required documents and evidence with certified true copy, signed by the authorized person on every page. If the authorized person is assigning a representative, a power of attorney letter from the authorized person with duty stamp attached is a must, and the documents can be submitted to the officer at the Maritime Regulatory Division on official working days and hours, or submitted through the website https://nsw.md.go.th. 

     The purpose of the ERC. 01 form is the consideration of granting or not granting permission to use ships other than Thai ships. The purpose of the ERC. 04 form is to verify the correctness of applying for a permission to use a ship other than a Thai ship. If the person ordering and importing does not comply with the permitted conditions, he or she must pay extra fees in such cases.
