Application for change of visa type of foreigners – To work in a company or partnership (Code B)

        Some foreigners who come to Thailand come to visit, come to study, or come to do some business, but they may be interested or persuaded to pursue an occupation legally in Thailand.  They must request to change the type of visa to a work visa in a company.

        The supporting documents for applying to change the type of visa to work in a company, Limited Partnership (Code B), are as follows:

1. TM.86, only for foreigners who have Tourist Visa or Transit Visa, to change the type of visa, or TM.87 form only for foreigners who do not have a visa but are allowed to stay in the kingdom, and P.30, PP.30 and PP.90 to apply for a visa;     

2. Copy of passport (such as personal information page, entry stamp, residence permit stamp (if any)), and departure card (TM.6);

3. 1 4X6 cm or 2-inch photo;    

4. Fee of 2,000 baht; 

5. Letter from the company explaining the necessity of hiring a foreigner and asking for cooperation in obtaining or requesting to change the type of visa. (Specify the name of the company, name of the applicant, position, knowledge, and reason for obtaining or requesting to change the type of visa to NON-B.)

      (Subject of the letter) “Apply for or change the type of visa” (to Immigration Office Commander);

6. Employment certificate (according to the form of the Department of Employment);    

7. Copy of juristic person registration certificate (certified by the registrar within the past 6 months);    

8. Copy of certificate of juristic person registration (Phor.Khor. 0401 Form);   

9. Copy of value added tax registration certificate (Phor.Phor. 20);

      Request for change of value added tax registration (Phor.Phor. 09), request for value added tax registration (Phor.Phor. 01), capital increase memorandum and list of shareholders (BOJ.5) (certified  by the registrar for not more than 6 months);

10. A copy of the latest year's financial statements (must be screened and certified by the Ministry of Commerce or the Revenue Department);

11. Copy of corporate income tax (PND. 50) (must be screened and certified by the Ministry of Commerce or the Revenue Department), together with the receipt;

12. A copy of the alien's academic transcript and proof of work experience (must be translated into English and certified by the foreigner's embassy in Thailand or abroad, and Legal Affairs Division, Department of Consular Affairs, Ministry of Foreign Affairs in Thailand);

13. A certificate of educational qualifications and work experience (Sor.Tor.Mor.4). (Attach a copy of the ID card with the signature of the witness.);   

14. Copy of the withholding tax list of Thai employees (PND. 1) (for the past 3 months, together with attaching a list of Thai employees from the 1st to the last. Must be certified by the Revenue Department with a receipt);

15. Letter asking for cooperation from the Office of the Board of Investment, the Industrial Estate Authority of Thailand, or the Petroleum Authority of Thailand (in cases involving BOI promotion);

16. Show the company's color pictures taken to show the building, company name plate, working conditions with employees working, desks within the company or buildings or warehouses, which show about 6-7 images of the job. Foreigners must take a picture with the director and attach a copy of the director's ID card with signature. (If the director is a foreigner, attach a copy of passport and work permit.);      

17. If P.N.D. 50 (Page 5, Line 3) does not have water and electricity bills, show the lease agreement, water and electricity bills, and telephone bills (previous 3 months);

18. Company map; 

19. Certification from relevant agencies.  Attach  a copy of the certification fee receipt


        However, permission is granted for no more than 90 days, if more than 15 days is remaining on the current visa. If the applicant is overstaying, an application cannot be filed.

Things you should know:

1. Applicants must come and do it by themselves every time.    

2. Applicants must have a residential notification according to Section 38, together with evidence of a residential notification.     

3. The applicant must sign every page of the document.   

[Signing is the same as certifying, so just “sign” is okay.] 

4. For copies of documents of the company or partnership, the authorized director, according to the certificate of registration, or the managing partner must sign every page, as well as stamping them with the company or partnership seal.
