In the past, many Thai workers have traveled to work in foreign countries. This includes those who traveled independently and those whose employers requested permission to take them abroad for work. In the case where the employer is the one arranging for employees to work overseas, the employer must seek permission to take their employees abroad and prepare the following supporting documents:
- Request for permission to take employees to work overseas (Form Chor Ngor 23), completed in its entirety (Original copy required).
- A contract or document showing the hiring agreement between the foreign employer and the requester, such as a contract the employer bids for work abroad, etc. (If the document is in a foreign language, it must be translated into Thai) (1 copy required). The original document must be shown on the day the request is submitted.
- A certification of business registration (issued no more than 6 months ago) (1 copy required). The original document must be shown on the day the request is submitted.
- A shareholders list (Form Bor Oor Chor 5), issued no more than 6 months ago (1 copy required). The original document must be shown on the day the request is submitted.
- A factory operation license (if any) (1 copy required). The original document must be shown on the day the request is submitted.
- Documents showing permission from the government or state agency allowing the employee to work in that country, such as a visa, N.O.C., etc. (1 copy required). The original document must be shown on the day the request is submitted.
- Documents showing permission from the employer's country's government allowing the requester to bring employees to work in the country (1 copy required). The original document must be shown on the day the request is submitted.
- Evidence that the employee is an employee of the company, such as Form Por Oor Dor 1 (for the last 6 months), evidence of membership in the Social Security Fund, or a Social Security health care certification card (1 copy required). The original document must be shown on the day the request is submitted.
- Proof that the employee is an employee of the company (4 original sets required). The conditions, duration of work, food and accommodation benefits, airfare, medical fees, wages (not less than the standard rate set by the Department), and life insurance coverage for the employee during and outside working hours should be specified.
- A list of employees who are going to work abroad and the branches where they will work abroad (4 original sets required).
- A power of attorney letter in which the employer delegates a specific person to submit and handle the case if the employer does not contact by themselves (with a 30 Baht stamp affixed) (Original copy required).
- The identification card of the grantor and the grantee of the power of attorney must be shown to the officer (1 copy required) if the employer does not contact by themselves.
