Criteria for Applying for a Bonded Warehouse License for Ship Repair or Construction Yard

     Anyone intending to apply for a license to establish a bonded warehouse for a ship repair or construction yard must submit an application to the Director-General of the Customs Department as specified in the prescribed form along with documents and evidence. The criteria for the license application are as follows:

1. It must be a state enterprise, government agency, company, or partnership legal entity that has registered capital and a stable financial status. The financial statements should not show cumulative losses. The eligible entity should:

     1.1 Be involved in ship repair, ship construction, or ship parts construction, with not less than fifty-one percent of the shares held by Thai nationals, unless the entity is promoted by investment promotion law.

     1.2 Be capable of repairing or building sea-going ships or parts of sea-going ships larger than sixty gross tons, with a certificate of capability from the Office of Water Transport Promotion and Maritime Commerce of the Marine Department.

2. Must not have a serious criminal record under the Customs Act and other related laws concerning customs within the last three years from the date of application. A "serious crime" means any violation that is punishable by law, including imprisonment.

3. Must have ownership rights, possessory rights, or the right to use the land where the warehouse is to be established, in accordance with the law. In case the proposed land is mortgaged, the mortgagee must give consent for the establishment of the bonded warehouse.

4. Must not be currently suspended from using the type of license applied for.

5. Must not have had the type of license applied for revoked, unless the license was revoked more than 3 years prior to the application date. In the case where the applicant is a legal entity, the administrators of the legal entity must not possess such prohibitions as well.

     These guidelines aim to ensure that only reliable entities are allowed to establish bonded warehouses for shipyards, safeguarding the interests of both the public and the Customs Department.
