Bail for foreigners suspected of crimes

         Foreigners wishing to enter Thailand for any purpose should do so legally in order to avoid violating the regulations and laws. However, if it is found that an offense has been committed, a foreigner may be subject to legal action and be arrested; bail may be allowed in certain cases, depending on the offense that has been committed. 

          The criteria for determining the bail amounts come under the Investigation Division, the Immigration Bureau, which specifies charges, penalty rates, and bail amounts for those who have committed offenses in many cases. The details for certain cases are as follows:

  • Forging and using forged documents (under Criminal Code Sections 264, 268). The penalty is imprisonment for not more than 3 years or a fine of not more than 6,000 baht or both. The bail amount is cash of 120,000 baht/bail bond with an appraisal price of 2 times the cash value;

     

  • Forging and using forged official documents (under the Criminal Code Sections 265, 268). The penalty is imprisonment from 6 months to 5 years and a fine from 1,000 baht to 10,000 baht. The bail amount is cash of 150,000 baht/bail bond with an appraisal price of 2 times the cash;

     

  • Forging and using a forged seal or officer's seal is subject to imprisonment from 1 year to 7 years and a fine from 2,000 baht to 14,000 baht. The bail amount is cash of 150,000 baht/bail bond with an appraisal price of 2 times the cash value;

     

  • Allowing an illegal foreigner to stay or hide, or assisting in any way for a foreigner who is known to enter the Kingdom in violation of the Immigration Act to be free from arrest (under the Immigration Act B.E. 2522 (1979), Section 64). The penalty is imprisonment for not more than 5 years and a fine of not more than 50,000 baht. The bail amount is cash of 100,000 baht (in the case of Thai persons)/cash of 200,000 baht (in the case of foreigners)/bail bond with an appraisal price of 2 times the cash value;

     

  • Bringing foreigners into the Kingdom or acting in any way that supports or assists or facilitates foreigners entering the Kingdom in violation of Immigration Act B.E. 2522 (1979)  (under the Immigration Act B.E. 2522 (1979), Section 64). The penalty is imprisonment for not more than 10 years and a fine of not more than 100,000 baht. The bail amount is cash of 100,000 baht (in the case of Thai persons)/cash of 200,000 baht (in the case of foreigners)/bail bond with an appraisal price of 2 times the cash value;

     

  • Being a foreigner entering and staying in the Kingdom without permission (under the Immigration Act B.E. 2522 (1979), Section 11, 12(1), 18, Second Paragraph, 62, 81). The penalty is imprisonment for not more than 2 years and a fine of not more than 20,000 baht. The bail amount is cash of 40,000 baht/bail bond with an appraisal price of 2 times the cash value.

     

  • Being a foreigner entering and staying in the Kingdom with an expiration of permission (under the Immigration Act B.E. 2522 (1979), Section 81). The penalty is imprisonment for not more than 2 years and a fine of not more than 20,000 baht. The bail amount is cash of 40,000 baht/bail bond with an appraisal price of 2 times the cash value.

     

  • Offenses under Sections on the  Prevention and Suppression of Trafficking in Women and Children Act B.E. 2540 (1997). The penalties are in accordance with the Criminal Code for sexual offenses and The bail amount is cash of 200,000 baht.

    (In the case of foreigners)/bail bond with an appraisal price of 2 times the cash value.
